Jurisdictional Scope of Court Ordered Gaming Prohibitions

Issue:

Was the intent of Standards 3.1.2(f), and 3.2.1(f) to include court orders from outside of Ontario? Are gaming operators expected to restrict a player’s access if they discover a player has a court ordered prohibition on gaming from a jurisdiction other than Ontario?

Response:

The Standards do not restrict the application of Standards 3.1.2(f) and 3.2.1(f) to court orders from Ontario courts. Recognizing that there is no duty for the Operator to proactively seek out court orders, all individuals that are known by the Operator to have been restricted from accessing the gaming site or playing a lottery scheme as a condition of a court order are covered under this Standard, regardless of the court order’s jurisdiction of origin.

3.1 Only eligible individuals are permitted access to a gaming site.

Requirements – At a minimum:

  1. The following individuals shall not be permitted access to the gaming site:
    1. An individual who is known by the Operator to have been restricted from accessing the gaming site or playing a lottery scheme as a condition of a court order;

3.2 Only eligible individuals are permitted to play a lottery scheme.

Requirements – At a minimum:

  1. The following individuals shall not be permitted to play lottery schemes
    1. An individual who is known by the Operator to have been restricted from accessing the gaming site or playing a lottery scheme as a condition of a court order;
