Horse Racing Licence Guide: Racetracks and Teletheatres

Under the Horse Racing Licence Act, 2015 and its regulations, the Alcohol and Gaming Commission of Ontario (AGCO) is responsible for the licensing of racetracks, teletheatres and racing participants.

This Guide contains detailed information to assist you in applying for the following licences and registrations:

  • Fair or Non-Extended Meet Licence
  • Operator - Pari-Mutuel Operations Licence
  • Racetrack Operator Licence
  • Racetrack Site Licence 
  • Special Event Teletheatre Registration
  • Teletheatre Location Registration

Note: You must submit your application online through the iAGCO portal. To access iAGCO, click on the “iAGCO Online Services” button at the top of the AGCO’s webpage. iAGCO provides an easy, convenient way to apply for, change and renew your horse racing-related licences and registrations anytime, from anywhere.

Important Information

RESPONSIBILITIES OF A HORSE RACING LICENCE/REGISTRATION HOLDER

For complete details about your legal responsibilities as a licence/registration holder, refer to the Horse Racing Licence Act and its regulations, copies of which are available online at www.e-laws.gov.on.ca or by contacting Publications Ontario at 416-326-5300 or toll-free at 1-800-668-9938.

FEES AND PAYMENT

  • Please refer to the AGCO’s Horse Racing Licensing Fees for the applicable fee.
  • When using online services, all payments under $30,000 must be made by Interac Online, Visa, MasterCard, Visa Debit, MasterCard Debit or pre-paid Visa or MasterCard. 
  • Payments of $30,000 or more must be made by money wire transfer or electronic funds transfer. Please note that cheques and cash (including USD) are not accepted.

All fees must be submitted at time of application and are non-refundable.

  • Do not misrepresent or omit any material fact(s). Each statement made in your application is subject to verification.
  • It is a serious offence to knowingly provide false information on the forms and on any attachments.
  • The provision of false, incomplete, or misleading information or the omission of information on the forms or in the documents submitted with your application, or the failure to notify the AGCO of any material changes to this information which occur after an application is filed, may also result in the refusal, suspension or revocation of your Horse Racing Licence.

Section 1: Types of licences

This Guide provides information on the following horse racing licences:

Application Name Description

Racetrack Operator Licence

This application is for a Racetrack Operator Licence to operate racetrack site(s) in Ontario.

Note: Applicant must also apply for a Racetrack Site Licence for each racetrack site they wish to operate.

Racetrack Site Licence   This application is for a Racetrack Site Licence which is required for each racetrack site operating in Ontario.

Note: Applicant must also hold a valid AGCO Racetrack Operator Licence.

Teletheatre Location Registration

A Teletheatre Location Registration allows for the operation of an off-track betting location in Ontario.

This application is completed by the operator of the premises where the Teletheatre will be located.

 

Note: Registration requires an agreement with an AGCO licensed Racetrack Operator.

Special Event Teletheatre Registration Permits the operation of a location that will not be a permanent Teletheatre, such as a special event or fundraiser where off-track betting will be operated by a licensed Racetrack Operator.

Note: Applicant must also hold a valid AGCO Racetrack Operator Licence.

Applicant must disclose individuals in the roles of Site Managers, Event Organizers, and Teletheatre Operations Manager. 

Fair or Non-Extended Meet Licence Permits the operation of horse racing at a location where the total number of race dates is fewer than seven (7) days per year.
Operator - Pari-Mutuel Operations Licence Permits an AGCO licensed Racetrack Operator to conduct pari-mutuel operations at a racetrack site where the applicant is not the holder of the Racetrack Site Licence

CONDITIONS

Under risk-based licensing, the Registrar may attach one or more conditions to your licence to help you minimize risks identified during the assessment process. 

Section 2: Required Information

To begin your application, you must submit the following:

  • Application Fee (Note: Not applicable to Operations - Pari-Mutuel Operations Licence)
  • Corporate Structure* (Note: Not applicable to Operator -Pari-Mutuel Operations Licence)
    Corporate structure information must be provided by the applicant corporation and by all corporations directly or indirectly holding 5% or more of the shares of the applicant.
  • Personal Disclosure* (Note: Not applicable to Operator - Pari-Mutuel Operations Licence)
    Personal Disclosure information must be provided by the following persons:
  • Sole Proprietors
  • All Officers and/or Directors
  • All Partners
  • Any shareholder holding 5% or more of any class of shares
  • On-site manager, if applicable.

  • Business Name Registration (Note: Not applicable to Operator - Pari-Mutuel Operations Licence applicants) 
    The business name under which you operate may have to be registered with the Ministry of Government and Consumer Services (MGCS). For information regarding business name registration please contact MGCS toll free at 1-800-361-3223 or visit the website at: http://www.serviceontario.ca.

Special Event Teletheatre applicants must:

  • Disclose information about individuals employed in the roles of: Site Manager; Event Organizer, and Teletheatre Operations Manager under the Disclosure of Premises Managers section of their online Special Event Teletheatre registration application on the iAGCO portal
  • Advise their local municipality and local horseperson’s association of their licensing application

Teletheatre Location Registration applicants must provide:

  • A letter of support from their associated racetrack confirming their intent to open a teletheatre location at the proposed site
  • One or more of the following documents: Certificate or Articles of Incorporation; Charter/By-Laws; Partnership Agreement; Limited Partnership Agreement; Limited Partnership Declaration; Shareholder’s Agreement; Trust Agreement; Letter of Good Standing (for Horse Racing only); any other constituting documentation relevant to the entity

Additional Documents

The following items are not required with the initial application, however, we recommend you submit them as soon as possible to ensure your licence is issued in a timely fashion.

  • Municipal Notification (Note: Only applicable to Teletheatre and Special Event Teletheatre applicants) 
    • Provide correspondence from your local municipality confirming that the site is properly zoned for use.
  • Agency Letters of Approval (“Compliance Letters”) (Note: Only applicable to Racetrack Site applicants)
    • Three Agency Letters of Approval (“compliance letters”) are required (Note: Not applicable to Operator: Pari-Mutuel Operations):
      • Building Department (Building Code Act, 1992)
      • Fire Protection Officer or Fire Marshal (Fire Protection and Prevention Act, 1997)
      • Public Health Department (Health Protection & Promotion Act)
    • Compliance letters that indicate your premises meets the current standards or by-laws administered by each agency are required. These letters must be signed and dated by the appropriate official.

You must scan and upload to iAGCO any required additional documents.

Section 3: Licence Renewals

As a courtesy, you will receive a renewal reminder from the AGCO sixty (60) days prior to the expiration date of your licence.

You must apply to renew your licence and submit the appropriate fee online via the iAGCO portal prior to the expiry date.

If the AGCO receives your application and fee(s) on or before the expiry date, you will receive a Renewal Confirmation Notice allowing you to operate until you receive your licence.

If the AGCO has not received your renewal application by the expiry date on your licence, your licence will expire.

Your Licence renewal application will also not be processed if there has been a change of ownership at the premises that has not been previously reported to the AGCO.

Section 4: Modifications to Existing Licences

Change a Race Date or Post Time
Race dates are approved with your licence application. Applicants who wish to make a mid-year amendment, variance or replacement to a race date must submit their mid-year calendar change request and business rationale to the OLG and Ontario Racing (OR), copying the AGCO Director of Racing. The OLG and OR will work with a Racetrack Operator until the proposed change and rationale is acceptable for approval. Approved calendar changes will be issued with the Racetrack Operator with the revised calendar and Notice of Decision.

Cancellations
Racetrack Operators who wish to cancel a race date (most commonly due to extreme weather) must notify AGCO Race Officials of the cancellation.

Post-Time Changes
Less than 30 minutes
Racetrack Operators who wish to make a post-time change less than 30 minutes before post time must notify AGCO Race Officials of these changes in advance.

More than 30 minutes
Racetrack Operators who wish to make a post-time change more than 30 minutes (or less than 30 minutes, but for more than a single race date) must submit (1) their request for post-time changes and business rationale to the OLG and OR, copying the Director of Racing and (2) an online Amendment “Modify Race Dates” in iAGCO.

Ownership Transfer - Teletheatre
Teletheatre Location Registration applicants must notify the AGCO of a full transfer of ownership for an existing Teletheatre Location Registration.

Relocation Teletheatre
Teletheatre Location Registration applicants wishing to relocate an existing teletheatre site to a new location (provided there is no change to the existing registrant), must notify the AGCO.

Section 5: Regulatory Submissions

Minor Racing Official List
Racetrack Site Licence holders must submit the name(s) of individual(s) as Minor Racing Officials for AGCO approval via a Regulatory Submission: Minor Racing Official List.

Note
Minor Racing Officials must be licensed as a Horseperson: Association Official with the AGCO. If they are not, the Racetrack Operator must inform them of the requirement to apply for an AGCO Association Official Licence. 

It is the responsibility of the Racetrack Operator to keep the Minor Racing Officials List current and to inform the AGCO of any changes to the approved Minor Racing Officials List.
