You can apply for an Affiliate Delivery Licence online, through the iAGCO portal . For help using iAGCO, please see iAGCO support. 

Note: You should allow at least eight (8) weeks to get a licence. However, the process can take longer if your application is incomplete or inaccurate.

New licence

You should apply for a new licence if:

• The liquor delivery service is a new business and has never had a licence
• The liquor delivery service was licensed, but the licensee failed to renew the licence prior to its expiry date
• The liquor delivery service was licensed, but the licensee will not consent to transferring the licence to you

Application process

Through your iAGCO account, you will be able to check the status of your application.

Note: If the Registrar proposes to refuse your application, you are entitled to a hearing before the Licence Appeal Tribunal (LAT). LAT will provide you with more information about the hearing process.

Fees

There is no fee associated with an Affiliate Delivery Licence.

Application checklist

The following documents are required to apply for an Affiliate Delivery Licence: 

• Disclosures (For more information, please refer to the Personal and Entity Disclosure Requirements Guide): 
  • Entity disclosure: must be provided by all applicants and by all entities directly or indirectly holding 10% or more of the outstanding shares, or a class of shares
  • Personal disclosure: must be provided from sole proprietors, officers/directors, partners, and any shareholder holding 10% or more of the outstanding shares or a class of shares, where applicable
• Signature form depending on who is submitting the application (available in iAGCO):
  • “Signature of Applicant - Corporation” required if the applicant is a corporation
  • “Signature of Partner(s)” required if the applicant is a partnership/limited partnership
  •  “Signature of Applicant represented by Agent/Representative” if the application is submitted on behalf of the Applicant.

• Tax compliance verification number and attestation. 

  Note: You can check this through the Ministry of Finance’s Tax Compliance Verification portal .

• Copy of business name registration, which you may have to register under the Business Names Act . 
• Any agreements, schematic diagrams, or other documentation demonstrating the affiliation with a Grocery Store Licensee or a Convenience Store Licensee with more than 20 active licences
• A List of Affiliated Licences, listing all grocery stores or convenience stores that you are affiliated with, including their licence numbers. 

Issuing the licence

Once the AGCO receives all the required fee and information and is satisfied that your liquor delivery service conforms with the Liquor Licence and Control Act, 2019 (LLCA) and its regulations, your application will be approved.

Renewing a licence

You must renew your licence before it expires. You cannot offer liquor delivery services without a valid licence.

The AGCO will remind you about renewing your licence 60 days, and again 7 days before your licence expires. You must apply to renew your licence before this expiry date. 

Note: If you licence expires, you must apply for a new Affiliate Delivery Licence.

Application Checklist

The following documents are required to renew an Affiliate Delivery Licence:

If the AGCO receives your application by the expiry date, we’ll send you confirmation of your renewal application.  

Transferring a licence

An Affiliate Delivery Licence can be transferred provided that all regulatory requirements are met. A transfer is required if there is a prescribed change in ownership to the licensee or if a different person acquires the licence.  

Transfer licences are issued for the remaining time period on the licence.

A transfer of the licence is required if:

• The licence is transferring to a different person.
• There is a change in officers or directors of a licensee that is a corporation, or of a corporation that effectively controls the activities authorized under the licence.
• A person becomes or ceases to be a partner of a licensee that is a partnership.
• A person or partnership acquires a beneficial interest in the licensed business, including acquiring shares of a licensee that is a corporation or of a corporation that effectively controls the business, that results in the person or partnership holding or controlling 10% or more of the outstanding shares, or of a class of shares, of the corporation.
• A person or partnership other than the licensee becomes entitled to any of the profits from the sale of liquor or liable for any obligations incurred from the activities authorized under the licence.

A transfer will not be approved if the current licensee has pending regulatory proceeding, an outstanding monetary penalty or if the recipient of the transfer would not be eligible to be issued a licence. Please confirm these details before applying for a transfer application.

Transfer Checklist

For transfers, the following documents may also be required:

• Consent to Transfer (indicating the agreement of the current licence holder to transfer the licence)
• Proof of Transfer (e.g. confirmation that the purchase of the business has been finalized)
• A List of Affiliated Licences, listing all grocery stores or convenience stores that you are affiliated with, including their licence numbers. 

The AGCO will send you a confirmation that your transfer application has been reviewed and whether any other information is required.

Reminder: Check the expiry date of the existing licence. If it expires in less than six (6) weeks, there may not be enough time to complete the transfer process before the current licence expires. In this case, a licence renewal is required. 

Temporary contracting out

A licensee may contract out the operation of the business to a person who is applying to receive the licence, if the regulatory requirements are met. The licensee remains liable under the licence during the period for which the operation of the business has been contracted out.

The ability to contract out the operation of the business expires once the licence is transferred or the AGCO issues a notice of proposal to refuse the licence transfer. 

As part of your application, you will need to complete an Authorization to Contract Out form through iAGCO.

Voluntary surrender of licence

If you decide to close your business or you don’t want to have a delivery licence anymore, you must surrender your Affiliate Delivery Licence to the AGCO by submitting a Voluntary Surrender of Licence form through iAGCO.

It is the licensee’s responsibility to ensure they and their employees and contractors are informed of the laws, regulations, standards or requirements established by the Registrar, and any conditions affecting their licence.
