Changes to the Schedule of Monetary Penalties Relating to the Cannabis Licence Act, 2018 and Ontario Regulation 468/18

On December 5, 2025, updates were made to the Schedule of Monetary Penalties: Cannabis Licence Act, 2018 and Ontario Regulation 468/18. The Schedule was established by the Board of the Alcohol and Gaming Commission of Ontario (AGCO) and approved by the Attorney General of Ontario following amendments of Ontario Regulation 468/18. The Schedule applies to cannabis retail licence and authorization holders.

Two new infractions and corresponding maximum penalty amounts for non-compliance have been added to the Schedule to reflect changes to section 17.1(2) and (3) of Ontario Regulation 468/18 under the Cannabis Licence Act, 2018 . These changes came into effect on January 1, 2025 and allow:

  • a Retail Store Authorization (RSA) holder who has requested the cancellation of their RSA to sell cannabis to another authorization holder; and
  • the corresponding purchase of the cannabis by another authorization holder.

A monetary penalty is a financial consequence paid by the licensee or permit holder for violating the Cannabis Licence Act, 2018, its regulation or the standards. Monetary penalties have been used by the AGCO as a compliance tool since 2009 and can act as a bridge between a warning and suspension or revocation of a licence or an authorization.

Monetary penalties provide the Registrar of the AGCO with a tool to support a compliance-based regulatory regime and to ensure that the sector continues to operate with honesty, integrity and in accordance with the law. The amount of the monetary penalty will be based on the approved Schedule. Each infraction has a certain maximum monetary penalty associated with it. The ranges of monetary penalties are designed to address the specific risks posed by each infraction. It is important to note the amounts listed in the Schedule are maximums only and that penalties assessed may actually fall lower in the potential range, based on individual circumstances.
