Loonie Progressive Game Licence Terms and Conditions

DEFINITIONS

bingo hall means a type of charitable gaming site where a charitable organization conducts and manages a lottery scheme under the authority of a licence  issued by a municipality or by the Registrar.

bingo paper means a device of pre-printed numbers on disposable paper, cards or books or reusable hardboard or plastic cards.

bona fide member means a member in good standing of the licensee who has other activities, beyond conducting lotteries, within the organization. “Members of convenience” whose only activity is to assist with the Loonie Progressive Game are not considered bona fide members.

books and records means documents outlining financial details of lottery events and includes, but is not limited to, ledgers, sub ledgers, cheque books, cheque stubs, deposit books, deposit slips, bank statements, cancelled cheques, receipts, invoices and control sheets.

charitable gaming site means a gaming site where a charitable organization conducts and manages a lottery scheme under the authority of a licence issued by a municipality or by the Registrar.

gaming site means premises or an electronic channel maintained for the purpose of playing or operating a lottery scheme.

Hall Charities Association (HCA) means an association formed by all the licensees conducting bingo and other lotteries within a charitable gaming site.

hall rental means payment made by the licensee to a bingo hall Operator registered under the Gaming Control Act, 1992 from event proceeds, calculated per these terms and conditions. For the hall rental received, the bingo hall Operator provides goods and services to the licensee for the conduct of the event which include, but are not limited to, bingo paper, security, storage, gaming equipment, office equipment, materials, utilities and employee services.

licence means a license issued for a Loonie Progressive Game.

licensee means an organization that has been issued a licence to conduct a lottery under Section 207 of the Criminal Code of Canada and includes a Hall Charities Association.

licensing authority means the Registrar of Alcohol and Gaming.

Loonie Progressive Game means a game, held in conjunction with a Regular Bingo event, which is played in accordance with these terms and conditions.

Operator means a person registered under the Gaming Control Act, 1992 to operate a gaming site.

Registrar means the Registrar of Alcohol and Gaming.

Regular Bingo event means a licence permitting the conduct of bingo where the total prizes for any one (1) event do not exceed $5,500.

Every Loonie Progressive Game licence is subject to the following terms and conditions, as well as the Lottery Licence Terms and Conditions (4240)

and may be subject to audit and investigation by a licensing authority. A breach of any term and condition can result in the cancellation or suspension of the licence or in prosecution.

It is a condition of each licence that:

(1) General

1.1 The licensee is responsible and accountable for the overall management and conduct of the Loonie Progressive Game.

1.2 The licensee will control and decide all operational, administrative and staffing requirements related to the conduct of the Loonie Progressive Game.

1.3 The licensee must comply with all federal, provincial and municipal laws including the Criminal Code of Canada and the Gaming Control Act, 1992 and Regulations.

1.4 The licensee must conduct the Loonie Progressive Game in accordance with the information supplied in the application and approved by the licence.

1.5 The original licence must be displayed at the premises where the Loonie Progressive Game is being conducted.

1.6 Each Loonie Progressive Game must be conducted and managed:

  1. by a Hall Charities Association where the Loonie Progressive Game is being conducted in a bingo hall or in a premises exempt from registration as defined under the Gaming Control Act, 1992 and Regulations; or
  2. by the licensee conducting the Regular Bingo event in all other cases.

(2) Staffing - Hall Charities Associations 

2.1 Each Loonie Progressive Game must be conducted and managed by a Hall Charities Association.

2.2 The Hall Charities Association must designate at least two (2) bona fide, active members of the association to be in charge of and responsible for the conduct and management of the Loonie Progressive Game. The designated members in charge must be at least 18 years of age and, on behalf of the association be responsible for:

  1. administering the Loonie Progressive Game;
  2. opening and maintaining a separate account designated as a “trust account” by the bank or other financial institution to administer Loonie Progressive Game revenues; the Loonie Progressive trust account must be administered in accordance with Section 11 of these terms and conditions;
  3. supervising all activities related to the conduct of the Loonie Progressive Game;
  4. providing and arranging for provision of services by its member organizations with respect to the operation of the Loonie Progressive Game and administering the disbursements of monies derived from this game to its member organizations;
  5. completing and filing the required financial report on the results of the event;
  6. ensuring that all terms and conditions of the licence and any additional conditions imposed by the licensing authority, are complied with;
  7. managing and conducting the sales of Loonie Progressive Game tickets;
  8. reconciling all Loonie Progressive Game tickets;
  9. verification of all Loonie Progressive Game winners;
  10. ensuring that proceeds raised are periodically distributed to all member organizations participating in the Hall Charities Association;
  11. keeping all required records and administering the Loonie Progressive Game trust account.

(3) Staffing - Individual licensees 

3.1 Where there is no Hall Charities Association, the individual licensee must manage and conduct the Loonie Progressive Game. The licensee must designate at least two (2) bona fide, active members of the licensee who will be in charge of and responsible for the conduct and management of the Loonie Progressive Game in accordance with Section 2.2 (a, c, e, f, g, h, i, j and k). The designated members in charge must be at least 18 years of age.

(4) Conduct of the event 

The Loonie Progressive Game must be conducted and managed in conjunction with the Regular Bingo event as approved on the application for licence.

(5) Loonie progressive game ticket 

5.1 The licensee must not sell a Loonie Progressive Game ticket to any person under the age of 18.

5.2 The licensee must sell tickets for the Loonie Progressive Game for the price approved on the licence application.

5.3 The licensee must have tickets for the Loonie Progressive Game printed in two parts. Both parts must contain the following:

  1. space for the name of the Loonie Progressive Game player;
  2. hall location, space for session, date and time of the Loonie Progressive Game event;
  3. the price of each ticket;
  4. the number of the ticket (consecutively numbered).

5.4 At the request of the licensing authority, the licensee must provide a sample of the ticket.

(6) Advertising 

6.1 Advertising and promotional costs incurred by the licensee must not exceed two (2) per cent of the actual prizes awarded for all Loonie Progressive Game events based on the previous licence period.

(7) Prizes 

7.1 The prize for each Loonie Progressive Game must be awarded to the person or persons achieving a bingo in accordance with the Rules of Play attached to and forming part of these terms and conditions.

7.2 The Loonie Progressive Game prize may accumulate to an amount not to exceed $5,000. When the Loonie Progressive Game prize has reached $5,000 all additional revenue must be deposited into the Loonie Progressive Game designated lottery trust account.

7.3 At any session where the Loonie Progressive Game prize is not won, the Loonie Progressive Game prize must be added to the next licensed Loonie Progressive Game event up to the maximum set out in the Rules of Play.

7.4 Winners must have purchased a ticket for the Loonie Progressive Game in order to claim the Loonie Progressive prize.

7.5 The licensee is responsible for the verification of the winning card and for awarding the Loonie Progressive Game prize.

7.6 The licensee is responsible for the verification of the winning card and for awarding the Loonie Progressive Game prize.

(8) Proceeds and expenses 

8.1 All prizes and expenses incurred as a result of conducting and managing the Loonie Progressive Game must be deducted and paid out from the gross receipts derived from the Loonie Progressive Game revenues.

8.2 The licensee must not use monies from any other source to pay for expenses related to the Loonie Progressive Game.

8.3 Expenses must be reasonable and directly related to the conduct of the Loonie Progressive Game.

8.4 Expenses of licensees using the services of an Operator of a bingo hall, expenses of licensees not using the services of an Operator and bona fide member expenses must be paid from the gross receipts derived from the Loonie Progressive Game and must not exceed the amounts prescribed in Section 9.2, 9.3 and 9.4 of the Regular and Special Bingo Licence Terms and Conditions.

(9) American currency 

9.1 American currency may be accepted as payment for the Loonie Progressive Game in accordance with Section 10 of the Regular and Special Bingo Licence Terms and Conditions only by licensees permitted to accept American currency.

(10) Books and Records

10.1 The licensee must maintain detailed records of the disbursement of all proceeds related to the conduct and management of the Loonie Progressive Game and of all monies received by the licensee that were derived from the conduct and management of the Loonie Progressive Game in accordance with Section 11 of the Regular and Special Bingo Licence Terms and Conditions.

(11) Banking and financial 

11.1 The licensee must follow the banking and financial procedures set out in Section 12 of the Regular and Special Bingo Licence Terms and Conditions.

(12) Reporting requirements 

12.1 The licensee must provide the licensing authority with a financial report outlining the results of the Loonie Progressive Game on the prescribed form. Copies of all deposit slips related to the events, verified and stamped by the bank, must accompany the financial report.

12.2 The financial report must be filed by the 15th day of each month outlining the financial details of the Loonie Progressive Game events for the previous month. The licensing authority may request additional information or documents including invoices or receipts for each cost or expense incurred.
